• You are solely responsible for handling any comments or complaints related to Your E-Commerce, including without limitation any issues about payments, promotions, refunds or chargebacks.

• You agree to post and make clearly available on Your Sites a privacy policy, and any other terms or policies that may be needed by law, and you warrant that Your Sites and Your E-Commerce will follow with all applicable laws and regulations.

Payment of Fees

There are various payment term options available?(COD, Debit, Credit Or Net Banking,) and depending on the payment term decided with Local Mafiya he merchant has to pay on the pre-decided monthly, quarterly, half-yearly or annually terms. The merchant or seller has to pay within a week from the date of Invoice, or he/she risks the chance of closure or termination of the online store. All fees are exclusive of all state and central taxes, service, sales tax,GST or other taxes, fees or charges now in force or enacted in the future (“Taxes”). Bear in mind that Local Mafiya does not provide refunds.

Cancellation and Termination

Once your account is canceled all of your Content will be instantly deleted from the Service. We reserve the right to modify or terminate the Local Mafiya service for any reason, without notice at any time. Without limiting any other remedies, we may suspend or terminate your account if we suspect that you have engaged in fraudulent activity in connection with the Site.

Terms Of Use - User

As a condition to Your use of the Website, You must be 18 (eighteen) years of age or older to use or visit the Website in any manner. By visiting the Website or accepting these Terms of Use, You represent and warrant to Local mafiya that You are 18 (eighteen) years of age or older, and that You have the right, authority and capacity to use the Website and agree to and abide by these Terms of Use

You agree and acknowledge that the Website is a platform that You and Merchant / Vendor utilize to meet and interact with another for their transactions. Local mafiya is not and cannot be a party to or save as except as may be provided in these Terms of Use, control in any manner, any transaction between You and Merchant / Vendor

The arrangement between Merchant / Vendor, You and Us shall be governed in accordance with these Terms of Use. The Services would be made available to such natural persons who have agreed to use the Website after obtaining due registration, in accordance with the procedure as determined by Us, from time to time, (referred to as “You” or “Your” or “Yourself” or “User”, which terms shall also include natural persons who are accessing the Website merely as visitors). The Services are offered to you through various modes which shall include issue of discount coupons and vouchers that can be redeemed for various goods/ services offered for sale by relevant Merchant / Vendor. To facilitate the relation between You and Merchant / Vendor through the Website, Local mafiya shall send to You (promotional content including but not limited to emailers, notifications and messages).

These Terms of Use is published in compliance of, and is governed by the provisions of Indian laws, including but limited to:

i. the Indian Contract Act, 1872 (“Contract Act”);

ii. the (Indian) Information Technology Act, 2000 (“IT Act”) and the rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011, and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (“IG Guidelines”);

iii. The Consumer Protection Act, 1986.

You understand and agree that all commercial / contractual terms, with respect to the sale/ purchase/ delivery and consumption of the Goods and Services are offered by and agreed to between You and the Merchant / Vendor and the contract for purchase of any of the Goods and Services, offered for sale on the Website or app by the Merchant / Vendor shall strictly be a bipartite contract between the Merchant / Vendor and You.

Local mafiya is not responsible for any unsatisfactory, delayed, non-performance or breach of the contract entered into between You and Merchant / Vendor for purchase and sale of goods or services offered by such Merchant / Vendor on the Website or app

Local mafiya cannot and does not guarantee that the concerned Merchant / Vendor will perform any transaction concluded on the Website or app

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Delivery of Goods

1. The goods and Services shall be delivered by the Merchant / Vendor or independent contractors. You accept and acknowledges that the Merchant / Vendor or such other transporter/ courier/ delivery personnel, engaged by the Merchant / Vendor or Local mafiya, shall be independent contractors in-charge of the delivery of the goods and Services from the concerned Merchant / Vendor to the address notified by You. with no control over the goods and Services and no additional obligation apart from standard delivery obligations and duty of care.

2. You further accept and acknowledge that Local mafiya does not engage in the distribution of the Goods and Services, and may provide the services of a third party transporter/ courier delivery personnel for the purposes of delivery of Goods and Services from the concerned Merchant / Vendor to the address notified by You
